Committee of Adjustment
The Committee of Adjustment has authority, under The Planning Act, to review and grant decisions on applications for the severance of land, validation of title and the granting of minor variances pertaining to the regulations contained in the Zoning By-law. The public meetings are scheduled for the first Tuesday of the month or at the call of the Chair.
Consent to Sever
A Severance Application may be employed to create a new lot if it is demonstrated that a Plan of Subdivision is not necessary for the proper and orderly development of the land. The Committee's decision will address the municipal matters regarding, but not limited to, parkland dedication or cash-in-lieu of parkland, site servicing and parking. The impact on the neighbourhood is assessed prior to the Committee making their decision. An Application for Consent can create a new lot, an addition to a lot, an easement or a right-of-way or validate title.
Minor Variance
A minor variance is required when the Regulations in the Zoning By-law cannot be met due to the circumstances of new construction, addition or renovation. Typically, the minor variance requests the reduction of a certain requirement, i.e. setbacks, lot coverage or building height for reasons as required by the applicant. A change of land use or increase of density does not constitute a minor variance.
