What type of Open Air Burning is allowed in Midland?

Recreational backyard fires are allowed in Midland provided the resident first purchases an Open Air Burn Permit from the Town, and follows the Town's Open Air Burning by-law 2023-14. 

Open Air Burning By-law Rules

  • No burning unless a permit has been issued by the Town of Midland
  • No Burning when the wind speed exceeds twenty-four (24) kilometers per hour.
  • No Burning when a "Smog Alert" or Humidex advisory is in effect for South-Central Ontario.
  • No Burning when rain or fog is present.
  • Burning is only allowed between the hours of 4:00 p.m. through 12 midnight, unless otherwise expressly permitted by the Officer.
  • No burning material other than clean dry wood which is free and clear from any finishes, preservatives or other material that may be affixed to the wood in accordance with the Environmental Protection Act, R.S.O. 1990, c.E.19, as amended.
  • No person shall set or maintain a fire that is creating a nuisance or has an adverse effect on a neighbouring property(s) or property owners.
  • No Burning in a manner that creates excessive smoke.
  • A fire is not permitted if it contains more than 0.6 cubic metre of material burning at any one time and exceeds 0.6 metres in diameter.
  • A fire is not permitted if it is within 3 metres of any structure, hedge, fence, vehicular roadway, property line or overhead wire or obstruction of any kind or nature whatsoever.
  • Before you light a fire you must first ensure a person is:
    1. Able to supervise such fire;
    2. Has adequate tools and/or water to extinguish it promptly;
    3. Is in constant immediate attendance at the specific place where the fire is burning.
  • No person shall leave the specific place where the fire is burning without first ensuring such fire is completely extinguished.
  • No Burning when a fire ban is in effect.
  • A fire is not permitted in a chiminea/outdoor fireplace unless it is located on a non-combustible surface extending beyond the unit to a dimension equal to the height of the unit.

Purchase a Permit 

Permit Policy
  • Permits are $40.00 and valid in the year purchased.
  • Open air burn permits will only be issued to property owners. If the resident is not the property owner, a written authorization from the property owner is required. Tenants can bring in a signed letter or complete the Property Owner Permission to Burn form.
  • Permits must be visible from the road when you have a backyard fire.
  • Violation of the terms of the permit could result in a fine and the fire permit may be revoked without refund. 
  • Properties on Cook Drive and Wright Drive must first be inspected by the Midland Fire Department prior to a permit being issued. If this applies to you please call 705-526-4275 for an inspection.
Purchase Permit In Person
  • Visit the Town Hall at 575 Dominion Avenue to purchase your permit.
  •  Cash, debit or credit payments available. 

To expedite the process please bring a completed Application Form and Property Owner Permission to Burn form (if required).

Purchase Permit Online
  • Credit card payment only.
  • Permit Format:
    • A PDF copy of the Permit will be emailed to the applicant once payment is received, normally within the same business day, however please allow up to 2 business days for processing. 
    • Or you can pick up a printed copy of the permit at the Town Hall at 575 Dominion Avenue. Please call ahead to ensure your permit is ready.
  • Visit our Online Portal to apply and pay for your permit.
Purchase Permit By Email

Email a completed Application Form and Property Owner Permission to Burn Form (if required) to service@midland.ca.

  • Customer Service staff will call you for your credit card information. Please do not include credit card information in the email.
  • Permit Format:
    • A PDF copy of the Permit will be emailed to you once payment is received, normally within the same business day, however please allow up to 2 business days for processing. 
    • Or you can pick up a printed copy at the Town Hall at 575 Dominion Avenue. Please call ahead to ensure your permit is ready at 705-526-4275, ext. 2223.
