The Town's previous Pool Enclosure By-law was adopted in 1999 to regulate fencing requirements for privately owned outdoor swimming pools. The By-law primarily focuses on establishing minimum fencing and gate standards, requiring owners to obtain a permit, and providing general enforcement provisions under the Provincial Offences Act. Staff have reviewed the By-law and have determined that it was in need of updating and modernization. 

The updated (2026) Pool Enclosure By-law expands upon the framework by broadening scope, clarifying permit and construction requirements, and strengthening safety and enforcement measures. The updated introduced updated definitions to reflect modern pool types and related equipment, established a clear defined permit process with detailed application requirements, and updated construction standards to address current materials, designs, and spa products.

In addition, the updated by-law introduced provisions for new pool categories, recognizes legally compliant existing enclosures, requires temporary fencing during construction, and establishes ongoing maintenance obligations. Enhanced enforcement tools are also included, such as inspections, orders, and administrative monetary penalties, replacing the more limited enforcement framework of the former by-law.
