The Municipal Elections Act requires municipal Council, before October 1 in an election year, to establish a compliance audit committee under Section 88.33 to address possible contraventions of the Act’s election campaign finance provisions.
Committee Responsibilities
The Joint Election Compliance Audit Committee reviews applications for compliance audits and considers reports from the Clerk on apparent contraventions of contribution limits, ensuring compliance with the Municipal Elections Act.
Functions of the Committee
All financial statements submitted by candidates and registered third party advertisers are available on the Town's website. An individual who is an eligible elector is able to submit an application to the Joint Compliance Audit Committee if the individual believes on reasonable grounds that a candidate or registered third party advertiser (TPA) has contravened a section of the Municipal Elections Act only as it pertains to election campaign finances. An application may be filed to the Committee, even if a candidate or TPA has not filed their financial statements.
The County of Simcoe Clerk will facilitate the compliance audit process. Within ten (10) days of the municipal clerk receiving the application, it will be provided to the Joint CAC members. All reasonable notice of meetings to the public, candidate or TPA, and applicant will be provided.
Participating Municipalities
The participating municipalities in the Joint CAC are Adjala-Tosorontio, Bradford-West Gwillimbury, Clearview, Collingwood, Essa, Innisfil, Midland, New Tecumseth, Oro-Medonte, Penetanguishene, Ramara, Severn, Springwater, Tay, Tiny, Wasaga Beach, and the City of Orillia. The committee members were all appointed by by-law in each participating municipality.
