Commissioning of Oaths and Affidavits
A Commissioner of Oaths is a person authorized by the Province of Ontario, under the Commissioners for Taking Affidavits Act to administer oaths and take affidavits, declarations and affirmations. A Commissioner of Oaths does not certify that the statements being made in the affidavit or statutory declaration are true but only certifies that an oath or solemn affirmation has been administered.
The Commissioner is not responsible for the content of the affidavit; it is the responsibility of the person whose signature is being commissioned (the "deponent"). The deponent must understand not only the details to which he or she will attest but also the fact that he or she is swearing an oath that the details are correct. They must sign the document in the presence of the Commissioner of Oaths.
Commissioning Services
Please contact the Town of Midland by phone at 705-526-4275 ext. 2212, or email clerks@midland.ca, to make an appointment with a Commissioner of Oaths and Affidavits. This service is offered to Town of Midland residents only.
A Commissioner of Oaths is not the same as a Notary Public. The Town of Midland does not have a Notary Public on staff and therefore we are not able to notarize documents. Please contact a local law office to perform this service.
All commissioning services will take place in-person, by appointment, for a fee of $50.00 + HST ($56.50), cash/debit only.
- Deponent(s) must be present at the time of commissioning to sign the document in the presence of a Commissioner. If the form requires witnesses as well as a commissioner’s signature, the deponent should bring the required number of witnesses with them.
- You are required to present one original piece of government-issued photo identification (no copies permitted) i.e. a valid driver's license.
- The document being commissioned should be completed prior to arrival but NOT signed by the deponent until they are in front of the Commissioner.
Commissioners of Oaths are not authorized under the Commissioners for Taking Affidavits Act to certify documents as true copies.

- Domestic and Foreign Pension document (i.e. Proof of Life)
- Affidavit or Statutory Declaration (simple)
- Statement of Conscience or Religious Belief Vaccination Exemption
- Delayed Birth registrations
- Legal Name Change Applications (Service Ontario Form)
- Vehicle transfer of ownership to a family member; both parties must be present (donor/recipient)
- Child Travel Consent
- Affidavit of Proof of Loss of Motor Vehicle/boat (from an insurance company)
- Affidavit of Proof of Residency
- OSAP – statement of common law status
- Ontario Provincial Government related forms
Documents we cannot commission
- Estate, Will or Power of Attorney documents
- Divorce, separation, marriage, cohabitation or custody documents
- Court, Legal or Civil issue related documents
- Real Estate documents, including rental lease agreements
- Affidavits used for legal documents/proceedings/claims
- Documents that require a Notary Public
- Proof of Service
- Passports
- Timeshare Exit/Transfer Documents
- Documents related to debt
- Statement of Arrears
- Letter of Indemnity
- Ministry of Children, Community, and Social Services Family Responsibility Office forms (FRO)
- International educational institution or association documents, including photographs
- Declaration of a Translator
- Age of majority/Ontario photo ID applications
- Documents that are leaving the country
- Immigration applications
- ‘In lieu of guarantor’ documents
- Documents that require the signature of a witness or guarantor
- Certified True Copies (Commissioners are not authorized under the Commissioners for Taking Affidavits Act to certify documents as true copies)
