Notice of Intent to Remove Holding "H" Symbol | 16621 Highway 12
In accordance with Sections 34 & 36 of the Planning Act R.S.O. 1990 c.P.13., the Town of Midland intends to pass a Zoning By-law Amendment to remove a Holding “H” Symbol from East Part of Lot 101, Concession 2, in the Town of Midland, County of Simcoe, municipally known as 16621 Hwy 12 (‘subject lands’).
The subject lands are zoned Highway Commercial Holding “H” Symbol (HC-H). Section 3.36 of the Town of Midland Zoning By-law outlines that the removal of a Holding “H” Symbol is to occur by way of a Zoning By-law amendment. The requirement for the removal of the Holding “H” Symbol from the subject lands is:
- The approval and execution of a Site Plan Control Application pursuant to Section 41 of the Planning Act.
The Owner of the subject lands has fulfilled the requirement and has applied for a Zoning By-Law Amendment to remove the Holding “H” Symbol.
Pursuant to By-law 2025-50, being the delegated authority By-law of the Corporation of the Town of Midland, the authority to lift a Holding “H” Symbol has been delegated to staff.
