Property Tax Sales and Arrears

According to the Municipal Act, properties become eligible for tax sale once property taxes are two years in arrears.  The Town may prepare and register a Tax Arrears Certificate against the title to that land.

What is the tax sale process?

  • The Town will notify the property owner that the property taxes are in arrears.
  • The property owner will receive a tax arrears certificate that indicates the property will be sold if outstanding taxes are not paid within one year.

  • Once the tax arrears certificate is registered, partial payment cannot be accepted.

  • One year after the tax arrears certificate has been registered, the Town can advertise a Sale of Land by Public Tender in the next Municipal tax sale.
  • Once the property has been advertised, a Sale of Land by Public Tender package will be available to purchase, applicable fees may apply. 

 Frequently Asked Questions 

Does the minimum tender amount reflect the value of a tax sale property?

No, the property may be worth much more or much less than the minimum tender amount.

Are there open houses on tax sale properties?

Tax sales are not typical real estate transactions. The current property owner on title may still be occupying the property. Entering on to a property is considered trespassing.

Does the Town own or represent the title of the tax sale property?

The municipality makes no representation regarding the title to the property or any other matters relating to the lands to be sold. 

What is the responsibility of the tenderer?

It is the responsibility of the tenderer for researching this property to see if it is a good investment and researching the legislated requirements and provisions of the tax sale procedure. 

Where can you obtain a tender package?

A Sale of Land by Public Tender package can be obtained from the Town office or on the Ontario Tax Sale website. 

If my tender is not successful, how do I get my deposit back? 

Unsuccessful tenders will not be returned on the day of the tax sale opening. Tender packages and deposits will be available for pick up starting 5-7 business days after the sale date.

Valid Government issued photo identification is required for pick up:

  • Ontario Driver License
  • Canadian Passport
  • Ontario Photo Card
  • Canadian Permanent Resident Card
  • Articles of Incorporation - if application/deposit issued under a company name
  • Signed letter of authorization – if name does not appear on the application/cheque, or if a company has multiple owners

If the Government issued identification does not include an address or the address listed on the submitted tender is not the same.  Additional verification is required.

If arrangements are not made with the Town to pick up the package and deposit within 10 business days after the tax sale date, they will be sent to the address provided on the application form (Form 7) via mail, applicable fees may apply.
