The Committee of Adjustment is a committee, made up of Midland residents appointed by Council, that make decisions on applications for minor variances and consents. The same committee also functions as the Property Standards Committee which considers appeals related to the Property Standards By-law.

Minor Variance
The Zoning By-law regulates the use of land such as residential, commercial, industrial or institutional, as well as the:
  • location, size and height of buildings or structures
  • built form
  • sets out parking and loading requirements
  • other site specific requirements

All development proposals must meet the terms of the Town’s Zoning By-law. Whenever changes are made to a particular site and any of the regulations are not complied with, you will need a minor variance or amendment to the by-law to legalize the situation. The variance can relate to the land, building or structure or its use.

If a property owner wishes to make a minor change to the Zoning By-law regulations that would differ only slightly from the provisions, the owner may apply to the Committee of Adjustment for a minor variance, rather than a Zoning By-law Amendment.

Depending on the complexity of the proposal, the Town may recommend that you hire a private land use planner. They can help guide you through the process, complete your application package, and appear before the Committee on your behalf.

Consent
A consent is often referred to as a land severance. The most common types of consent applications are for land severance to divide a parcel of land into two or more new lots or as a lot addition to an abutting property. Examples of other consent applications may include, but are not limited to:
  • Mortgages over part of a property
  • Easements for servicing and right of ways for access over one property in favour of another
  • Validation of title to resolve conveyance oversights that contravene the Planning Act

Pre-Consultation

While Pre-Consultation with the Town is not required for a Minor Variance Application, it is encouraged and recommended that the owner or agent discuss the application with the Town prior to submission. 

Pre-Consultation is mandatory prior to submitting a Consent application.
